Kuwait: This new policy represents a concerning reinforcement of Kuwait’s contentious kafala system instead of its abolition. Human rights advocates caution that it intensifies the control employers have over migrant workers, making them more susceptible to exploitation and mistreatment. Despite official assertions that the exit permit serves to balance the interests of both employers and workers, critics contend that it gives employers excessive authority to limit workers’ movements.
Already facing restrictions due to passport confiscation and threats of false absconding charges, migrant workers now encounter yet another obstacle to their freedom of movement. Previously, Kuwaiti law required government permission only if a worker planned to be abroad for more than six months. The new regulation, however, necessitates employer approval for any departure, regardless of how long the worker intends to be away.
